Welcome to Findborg. These Terms of Use ("Terms") govern your access to and use of the Findborg platform at findborg.com, including all features, services, and content (collectively, the "Service"), operated by Findborg Inc. ("Findborg," "we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or 16 in the European Economic Area) to use the Service. By creating an account, you represent that you meet this age requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Your Account

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You agree to provide accurate, current, and complete information when creating your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

3. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation
• Post, upload, or share content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable
• Impersonate any person or entity, or misrepresent your affiliation
• Spam, phish, or distribute malware through the platform
• Attempt to gain unauthorized access to any part of the Service, other accounts, or connected systems
• Scrape, crawl, or use automated means to access the Service without our written permission
• Interfere with or disrupt the Service or servers/networks connected to it
• Use the Service to generate, store, or distribute content that exploits or harms minors
• Circumvent any content moderation, rate limiting, or access controls

4. User Content

4.1 Your Content

You retain ownership of content you create and submit to the Service ("User Content"), including community posts, comments, video submissions, TalkTag listings, and messages. By submitting User Content, you grant Findborg a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your User Content in connection with operating and improving the Service.

4.2 Content Moderation

We reserve the right to review, remove, or disable access to any User Content that violates these Terms, without prior notice. Community-reported content may be automatically flagged or temporarily hidden pending review.

4.3 Video Submissions

Videos submitted to Findborg must be content you have the right to share. By submitting a video, you confirm that the content does not infringe on any third-party rights. Submitted videos are subject to review and approval before appearing publicly.

5. AI-Generated Content

The Service includes AI-powered features such as the Borg assistant, search result summaries, breakdowns, and recommendations. Regarding AI-generated content:

• No guarantee of accuracy: AI-generated responses may contain errors, inaccuracies, or outdated information. Do not rely on AI output as professional, legal, medical, financial, or other expert advice.
• Not our opinions: AI-generated content does not represent the views or opinions of Findborg Inc.
• Use at your own risk: You are responsible for evaluating and verifying any AI-generated content before acting on it.
• Third-party AI providers: AI features are powered by third-party services (OpenAI) whose outputs we do not fully control.

6. Search Results and Third-Party Content

The Service displays search results, links, and content from third-party websites and sources. Findborg does not control, endorse, or guarantee the accuracy of third-party content. Your interactions with third-party sites are governed by their own terms and policies. Findborg is not responsible for any harm resulting from your use of third-party content or services.

7. TalkTag Listings

Users may submit product, service, or business listings ("TalkTags") to the platform. By creating a TalkTag listing, you represent that:

• All information provided is accurate and not misleading
• You have the right to list the product, service, or business described
• The listing does not infringe on any third-party intellectual property rights

We reserve the right to remove or modify listings that are inaccurate, misleading, or violate these Terms.

8. Intellectual Property

The Service, including its design, code, logos (the Findborg trident), brand elements, and original content, is owned by Findborg Inc. and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from our intellectual property without written permission.

9. Subscriptions and Payments

Certain features may require a paid subscription. If you purchase a subscription:

• Payments are processed by our third-party payment provider (SureCart).
• Subscription terms (pricing, billing cycle, features) are presented at the time of purchase.
• You may cancel your subscription at any time through your account settings. Access continues until the end of the current billing period.
• We reserve the right to change pricing with reasonable notice.

10. DMCA and Copyright Claims

We respect intellectual property rights. If you believe content on the Service infringes your copyright, please send a DMCA takedown notice to fitzflood@gmail.com with:

• Identification of the copyrighted work
• Identification of the infringing material and its location on the Service
• Your contact information
• A statement that you have a good faith belief the use is not authorized
• A statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the copyright owner
• Your physical or electronic signature

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT RESULTS OBTAINED FROM THE SERVICE (INCLUDING AI-GENERATED CONTENT AND SEARCH RESULTS) WILL BE ACCURATE OR RELIABLE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FINDBORG INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

13. Indemnification

You agree to indemnify and hold harmless Findborg Inc., its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service, your User Content, or your violation of these Terms.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. You may stop using the Service at any time. Upon termination, your right to use the Service ceases immediately, but provisions that by their nature should survive (such as Sections 4, 5, 11, 12, 13, and 16) will continue to apply.

15. Changes to These Terms

We may modify these Terms at any time. We will notify you of material changes by posting the revised Terms with a new effective date. Your continued use of the Service after changes constitutes acceptance. If you disagree with any changes, stop using the Service.

16. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts located in Florida.
